This Source Code License Agreement (“Agreement”) governs the terms under which the source code of the Swift PIP (“Software”) is made available by Biwa SARL (“Licensor”). By accessing or using the Software, you (“Licensee”) agree to comply with the terms set forth below.

1. License Grant

The Licensor hereby grants the Licensee a limited, non-exclusive, non-transferable, and revocable license to use the Software solely for the purpose of operating the associated application within the scope defined by the Atlassian Marketplace policies.

2. Source Code Access

Unless explicitly stated otherwise, the source code of the Software is not provided as part of this license. Any attempt to reverse-engineer, decompile, or otherwise access the source code is strictly prohibited.

3. Restrictions

The Licensee shall not:

  • Distribute, sublicense, or otherwise make the Software or any part of it available to any third party.
  • Modify, adapt, translate, or create derivative works based on the Software.
  • Use the Software for any purpose not expressly permitted under this Agreement.

4. Intellectual Property Rights

The Software, including its source code, is the sole property of the Licensor. This Agreement does not transfer any ownership rights to the Licensee. All rights not explicitly granted herein are reserved by the Licensor.

5. Termination

The Licensor reserves the right to terminate this Agreement immediately if the Licensee breaches any terms of this Agreement. Upon termination, the Licensee must cease all use of the Software and destroy all copies in its possession.

6. Disclaimer of Warranties

The Software is provided “as is,” without warranty of any kind, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose, and non-infringement. The Licensor is not responsible for any damage or loss resulting from the use of the Software.

7. Limitation of Liability

In no event shall the Licensor be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use of the Software.

8. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of France.
